But officials ignored the te st results and commited to build a thirty-eight million dollar courthouse in a perilously polluted pit. The project is now a disaster and when investigative reporter larry barker asked questions ... The answers he got were lies: santa fe county decided this spot in santa fe's downtown would wn be a good place to build a new $38 million dollar courthouse. Butco theres somethinger wronngg with this picture. They broke ground a year ago. And ar . Santa fe county has already shelled out 14el million dollars on the project. .barker: "but, the only thing they have to show for t it is this big holeth in the ground. The contractor was sent home six months ago. There's no erweldnoers, plumbers or rselectricians. What's going on he ore?" You see, the u courthouse is at seground zero of anndn environmental vi endisaster. .curry: "its not a good thing. I don't think its ever good to have a plume of gasolinee as... Egoing through the middle of a property that' s under construction. That's obvious." Jiusm davis is a scientist with the state environment department. .davis: "it is a major contamination problem, theres no doubt about it." Why construct a $38 million bunilding in a disaster zone? .barker: "to answer tha t question we need to go back 50, 60 years when s service stations like this were a common sight throughout new mexico. Gasoline was stored in huge underground tanks that over time would leak." Ou refined petroleumd that seeps into the soil doesn't evaporate or dissolve. Plum es of decades old gasoline are stillgane underground rotoday. And because it's highly igtoxic, the dangerous chemicals threaten new mexico's water supply. In santasu fe, scientists know refined gasoline has seeped into the ground from old leaky underground rotanks. .davis: "in terms of the amount of gasoline, the amount of contamination, atthis is a big deal."." Historically there were service stations adjacentio to santa fe an county property. And even though t those business es are long g one,lo over time, their leaking storage tanks dumped thousands of galls of refined petroleumfipe into the ground. Scientists know a poisonous plume has beenen migrating towards the s county's proposed coosurthouse site. And thats a problem. You can'tpr construct a building o n top of toxic waste. .abeyta: "we didn't know there was a wgasoline contamination plioume when we made the decision to place the courthouse there." .barker: "didn't know? Our investigation found, wellfo before the first shovelful of dirt was turned, the county did know its construction site was dangerously polluted. And rather than working with the state's environment nmdepartment too investigate, santave fe county simp ly looked the other way." Y. .curry: "the m ore questions wes asked the fewer answers we got."ans for example, in 2005 the state t asked to drill a d critically important test well on countywen property. The well would confirm whethernf the gasoline plume had migrated to the county propey. P roman abeyta is santa fe's county manager. .abeyta: "q. You had no problem with them putting in a monit oring well on county property? A. No. Ty but in fact, thehe county did have a problem andan refused the state's request. .davis: "q. Bottom line, the county would not let you dig that well? A. We did not receive permission from the county, that is corrsect." Instead of allowing statelo s scientists access, the county decided to do itsci own investigation into possible contamination.am .abeyta: "we put in 6 monitoring6 wells and they didn't sho w contamination." .barker: "even though abeyta says the samples ses came up cl ean, the county kept those test results from ul the environment depatrtment for five months. And now we know why. The county's own co tests showed the courthouse construction site was horribly hocontaminated withed dangerously high er y levels of toxic chemicals." Did the county wells come up clean with no contamination? .davis: "no they did not. Two of those six wells showed significant levels of benzine contamination in..they were well above standards.       <media:text>site for decades. others say it doesn't belong and needs to go. fox 11's robert hornacek has a balanced look at the future of nuclear power. it's one of the biggest issues facing the nuclear power industry: what to do with the radioactive waste? michael "ultimately you're gonna have to bury it, that was supposed to happen 11 years and several billion dollars ago. while the federal government tries to find a solution, local power plants are forced to keep their waste, on site. phil, "it's contained, it' )s monitored and it's safe." but people who live near the plants, say the waste wasn't part of the deal. david "it's just not right we're being dumped on. this is video from the 1990s inside the point beach nuclear power plant. once fuel rods are no longer used to generate electricity, they're stored in these pools. the water is used to cool the rods and shield the workers and the environment from radiation. after five years in the pools, some of the rods are transferred into dry cask storage. the radioactiveaste is sealed inside a metal cylinder which is then enclosed in a metal or concrete shell. david, "it's a dump. it's a nuclear waste dump and the town should be compensated for it." david hardtke is the town chairman in carlton, home of the kewaunee power station. in august, the plant, located right on the lake michigan shoreline, began storing spent fuel rods above ground, in huge concrete and steel casks. david "i don't know if people know that but there's high-level nuclear waste sitting 50 yards from the best freshwater body of water in this world and it's just sitting there on a concrete pad." jim, "dry cask storage is safe." democratic state representative jim soletski worked at the kewaunee power station for more than 20 years. he says the storage at kewaunee is more like 100 yards from the lake. jim, "the amount of waste is really a small amount." a few miles away, more spent fuel rods are being stored at the point beach nuclear power plant. point beach started storing the waste in dry casks in the 1990s. this is video from the mid-90s of one of those casks being built. soletski says the storage at point beach is 700 yards from the lake. jim, "if lake michigan got that close to it we'd have a lot more troubles to worry about that just nuclear, dry cask storage." the on site storage was supposed to be temporary. lee engelbrecht, "when they first put it out there we thought that but as we're moving on i'm not so sure anymore." lee engelbrecht is the town chairman in two creeks, which is right down the road from point beach. lee, "it is probably a risk but i think everybody living around here feels fairly safe with it but it doesn't belong here. that's our feeling." according the the nuclear regulatory commission, the casks are "safe and environmentally sound." the casks are designed to withstand "floods, tornadoes, projectiles, and temperature extremes." robert, "we wanted to show you what the dry cask storage looks like at both plants but we were not allowed on the property at point beach or kewaunee. we also spent more than one month trying to talk with the plants for this story, but neither would sit down for an interview." advocates for nuclear power like republican state representative phil montgomery have no problem with the on-site storage. phil "where it is stored right now, in the dry cask storage, is perfectly safe. there has never been death, an accident or an injury associated with storage or transportation of spent nuclear fuel. so it is entirely safe there." while some environmentalists, like katie nekola from clean wisconsin, say a long-term solution needs to be found. katie "they're sitting there exposed, of course we need a plan. we need safe geologic storage for the nuclear waste that's being generated." professor michael corradini is the chairman of nuclear engineering program at uw- madison. he says the waste needs to be buried deep undergrod. michael "the honest answer is the ultimate resting place would have to be geologic disposal. it's solid material, you're not gonna burn it. you're not gonna throw it into space. you're not gonna throw it in the ocean. so you have to bury it somewhere just like we bury all our current waste which is solid. so it's gotta be buried. that was the plan for more than 30 years. the federal government even had a site all picked out: yucca mountain in nevada, 100 miles northwest of las vegas. the waste was going to be put deep underground in tunnels. we even paid for some of it already. utility customers have paid more than $16- billion dollars into the nuclear waste fund. more than $350 million of that came from us in wisconsin. but the plan has been plagued with politics. earlier this year, the obama adminstration put what may be the final nail in the yucca mountain coffin. the plan was essentially scrapped as the federal government "devises a new strategy for nuclear waste disposal." we wanted to knowhat the owners of wisconsin's nuclear plants thought about the federal government pulling the plug on yucca mountain, but neither plant would talk with us for this story. town leaders near the plants aren't shy about their feelings. david, "i don't want the town of carlton to be known as a high level nuclear waste dump." towns like carlton and two creeks are trying to force the issue. they want to start charging the plants for keeping the waste on site. lee "towns that host landfills are compensated for that this would be no different i feel. hardtke "for 35 years they told us it was not going to stay here and now that they permanently shut down yucca mountain it's here and it' )s not leaving." montgomery says in the future, waste may not be an issue. th, he says, would lead to the development of more nuclear plants. phil "the next generation of nuclear power plants that are about 10 years away, we'll be able to recycle that spent fuel so i think that will be the tipping point. once people feel secure in the fact that the spent fuel is taken care of i believe that will be the tipping point." in the meantime, town leaders are fed up and confused about what to believe. hardtke "is it safe? maybe. the federal government said to be safe it had to go a mile under yucca mountain in the cast and sit there but over here, it can just sit on a concrete pad out in the open? which one is it? is it safe. i don't know. why did it have to be a mile under ground in nevada and over here it can be above the ground?" robert, "energy secretary steven chu has set up a task force to come up with a plan to deal with nuclear waste. chu has said the way the waste is being handled now, it can be safe for decades. he also said nuclear power is an essential part of the nation' )s       <media:text>battle creek offices will reopen tomorrow.. even though a mystery remains. what's making state workers in a calhoun county office building sick? sick?that's what employees and county officials would like to figure out... after offices housing the state's department of human services were shut down for the second time in recent months. 24 hour news eight's joe lafurgey has more from battle creek's toeller building. building. sometimes, it takes more than a phone call or an e mail to iron out a problem. a paperwork snafu cut heather busick's state benefits. a visit to her caseworker at the department of human services offices in calhoun county's toller building would fix the problem. but she and other clients learned of another problem. the d-h-s .. which occupies about half the space in calhoun county's toller building ... closed down their offices wednesday afternoon after employees complained about a number of ailments... from nose bleeds to respiratory distress. it's not the first d-h-s outbreak in recent months.the united autoworkers... which represents the 170 or so workers in the building sent in their own air quality team to investigate. they say they found dead birds in ceiling tiles and 200 pounds of sand in air ducts.but calhoun county... which owns the building.... did three air quality tests...including one this week.once again... the county test turned up nothing that would cause the health problems. so why aren't county employees suffering the same symptons. u-a-w reps for state employees say county officals are ignoring their eoemplyes complaints. but calhoun county officials says there';s nothing to compain about. they says their empolyees.. which include workers in the health department... simply aren't getting sick.still.. the search for answers</media:text>

      <media:text>one way a company in avon is staying committed to the environment. &gt;&gt; forecast 8 felicia roman examines what they are doing to stay green. &gt;&gt; debbie and eric, c.s.x. transportation is the company and the product they are using, trains. these particular freight trains promise to reduce pollution and will help for bringing cleaner air. &gt;&gt; it's good for the environment. it reduces fuel usage, the employees like them. and they're effective and efficient in the operations. &gt;&gt; that is what bob sullivan of s.x. transportation is saying about the new ultralow emission locomotives that were unveiled this afternoon. their primary function, to help reduce 80% of pollution emitted from the train. &gt;&gt; it reduces nitrous oxide and it reduces carbon dioxide and both of them, there are significant reductions there. &gt;&gt; one nice thing about the new jet set locomotives are they reduce emissions which will help improve the environment but they're a lot quieter than these existing locomotives. &gt;&gt; they're a lot quiter, about 80% reduction in noise compared to traditional locomotive engine. &gt;&gt; the new locomotives use three small engines as opposed to one large engine that runs constantly. the smaller engines a more fuel efficient. &gt;&gt; we're seeing about a 25% reduction in fue use compared to a more traditional single engine locomotive compared to the three engine one. &gt;&gt; they're doing everything we want. they're getting the job done. they're doing it in a fuel efficient way. they're doing it with reduced emissions and they're doing it in a quieter way and our employees seem to like working with them as well. so to us, it's an in an ideal situation. &gt;&gt; c.s.x. transportation is the first railroad in indiana to utilize these jet set locomotives. they say the two fuel efficient locomotives they unveiled this afternoon will replace two of the existing ones at the avon yard. the old ones will go out and be refitted</media:text>

      <media:text>the show. &gt;&gt; michelle, you love to tease me. target 12 investi2gator tim white recently did some digging and found danger on thd e ground. d. tim joins us now to tell us about ab this latest report. tim, temperature us about the investigation. &gt;&gt; we're looking at underground storage tanks. rhode island is an old industrial state, we have thousands of them across the state and those are just the ones regulated by the government and that the dem knows about. as a matter of fact, we have some video, if youf can call that up. this tank here was only in onlyville, they had no idea ity a was there, it was at an old industrial site, they followed ping, they went digging andd they found thouat tank, and a lot of these things holthd some pretty scary chemicals. &gt;&gt; and a lo t of a these things,ng i've done stories, similar to these before, these are 20,000-gallon tanks that a lot of gas stations use and companies use, and i guess the biggest danger is, they leach in to the environment. &gt;&gt; you've gotou it. that's when they becomey dangerous, they start to leak and the probleman is, you i don't know about them leaking until it shows up insh your water or it starts leaking into the basement of your air. in rhode islan d, the department of environment lal management knows about 300 tanks that are currently leaking right now. 300 tanks. and they are only able to t ackle a hanul of them a y aear. '80s real problem. &gt;&gt; i was going to i say, with theit economy the way it is, where do they get the money forked mediation? &gt;&gt; that's -- it shall for the mediation. &gt;&gt; the general assembly decided to cut t he funds in half and give it to rifta. estimate also money came in recently, but that's only going to deal with 20% w to 25% of the tanks. the scientists at the dem that this problem is only going to t grow, because thegr ust fund has u been cut in half. &gt;&gt; is this anything where a theth epa can jump in and try to take some responsibility off of the state? &gt;&gt; some of the tanks are federally regulated, some are regulated by the state, so that's where there epa would step in, but really where the rubber meets the road, the state stimulus money comes in, butom the dem still has to deal with the tanks and deal with w the gas station owners, a lot of the mom and pop places thatat have leaking tanks, they can't affordd the $200,000, $400,000 to pull the ll tank out of the o ground, let alone rehab the soil that's been destroyed. ye &gt;&gt; we've obviously just scratched the surface here, tim. thanks for joining us this morning and you can see c tim's entire investigation tonight at 10 on fox providence and then again at 11:00 p.m. on eyewitness news</media:text>

"i think it's time to come clear withhe public." frank ortega who worked in solid waste for 25 years and retired as a maintenance manager in 2007 says much of the material might as well be thrown into the dump because mold and mildew has likely ruined its recycling potential. "jojola: so all of this stuff was meant to be recycled, and now it's contaminated ... "ortega: it's contaminated" ortega says he was routinely trained in recling during his time at the landfill and believes without a doubt the city is trying to hide the pile from public view because it proves there's a problem.
