Thursday, federal and state officials reached $26 billion settlement with five of the nation's biggest lenders accused of mortgage abuse.  California will get $18 billion.
     
The settlement gives those on the verge of losing their homes more options to lower their payments. A local realtor says he thinks the move will help speed up the recovery of our real estate market.

&quot;If this settlement can help people stay in their homes, valuations should stabilize and gain some traction down the road.  Because the less foreclosures in the Central Valley, the better it is for real estate prices,&quot; said Joel Mazmanian of Realty Concepts.

The money likely won't be available for another four months.  However, state leaders say you should begin inquiring about it now so you'll be in position to take advantage of the benefits when the money kicks in.</media:text>

El acuerdo anunciado por el fiscal general de la nacion Eric Holder se&#241;ala que los grupos Ally Finantial, Bank of America, Citigroup, JP Morgan y Wells Fargo deberan consignar 25 mil millones de dolares para aliviar la situacion de las hipotecas bajo el agua en 49 estados y reducir las cuotas de pago de mas de un millon de deudores hipotecarios.
Localmente, la fiscal Martha Coakely anuncio que Massachusetts recibiria 318 millones en asistencia para la reformulacion de las hipotecas y para la distribucion de cheques de hasta dos mil dolares entre los afectados. Las organizaciones que localmente lidian con esta problematica reaccionaron ante acuerdo. &quot;Toda la gente que tiene prestamos o propiedades garantizados por el gobierno federal de las agencias de Sallie Mae y Freddie Mac no estan elegibles para beneficiarse de ese acuerdo y son 56 por ciento de los prestamos de este pais son garantizados por Fannie Mae y Freddie Mac.&quot;

      <media:text>i'm dana wagner filling in for kim today. if you lost a home to foreclosure you're not alone. you may be in line to receive a big check from a big bank. some financial help for those who need it. five of the country's largest mortgage lender reached a settlement over foreclosure abus. federal officials say 49 states signed on to 26 billion dollar deal but the state attorney general's office hasn't confirmed if nevada is part of that agreement. terms of the deal require bank of america, j.p. morgan chase, wells fargo, citigroup and ali financial to reimburse american homeowner whose lost their homes to foreclosureithin three years. each homeowner could receive as much as $2000. the agreement also forces the lender to reduce mortgage principles for a million homeowners. attorney general eric holder and hud secretary shaun donovan said the deal offers protection and punishment. &gt;&gt;&gt; this agreement establishes significant new homeowner protections to help prevent future misconduct. it also provides substantial financial assistance to victim borrowers. this isn't just about punishing the banks for irresponsible behavior but helping the people they harmed by funding efforts to help homeowners stay in their homes. &gt;&gt; and the federal a deal on lawsuit filed by nevada gent lender countrywide which is now part of bank of america. the suit accused countrywide of violating the ambassador consent degree on mortgage servicing. we're told nevada attory general catherine cortez mastor</media:text>

      <media:text>&gt;&gt; welcome back. if you own a home that's worth much less than when you bought it, the reality can be brutal. many folks who are in this position and are considering their options. if that's you, our next guest may be able to help you get outside from being upside-down. &gt;&gt; here to answer any questions you might have is mike chobani a realtor who specializes in distressed properties. &gt;&gt; hello. &gt;&gt;thank you. &gt;&gt; welcome back. &gt;&gt; what's the economic outlook for vegas looking like right now. &gt;&gt; we are going through an election year so that could be -- we might see positive cnges. however, it's going to be to the minimum. las vegas still is suffering one of the worst economies in the country, unemployment is very high. housing cris will continue for at least ather three, four years. the prices are the worst they have ever been. &gt;&gt; so -- what advice do you have for people who are upside-down on their properties as so many people are? &gt;&gt; if you are upside-down like 80% of las vegas homeowners, whether you are current or in default, best thing to do is eliminate your negative debt. get rid of it. and because there's no light under -- in this tunnel unfortunately, it's going to take at least 10 to 15 years for the houses to recoup in value. and where people bought them at. if you are in default, the best thing to do is short sale to avoid foreclosure. short sale you can offer within a couple of years. foreclosure is a bad as bankruptcy and it's free. just take advantage of it. &gt;&gt; are you short sale if you are current as well. &gt;&gt; yep. &gt;&gt; got you. &gt;&gt; there are people who bought their homes can still afford it but are taking hits because of property values have depreciated. &gt;&gt; bad. &gt;&gt; so much. &gt;&gt; if you are going to do a short sale, what do you need to know? &gt;&gt; well, the best thing to do is give us a call. get free consultation and learn about your options in detail. if you are upside-down, depending how upside-down you are, only 25% or so, you actually might qualify for e hart program and reinnocence yourself. your loan and just keep your house and continue making your payments. if you are like the rest of las vegas home oceans, 30% to 60% upside-down, eliminate your negative debt and get rid of it. it is free. you might get money towards moving out of the house, around $3,000 or so, and there's another option which is really great, if you are current and you can afford a second home. buy another house and take advantage of the low prices that will average your losses, and pretty much make money from one, whether you might have lost another one. write it out or move into it. there's a lot of options. &gt;&gt; there are some people who might be moving from the las vegas area to go to other states that might have found jobs there or living with family there. how do they get out of their houses, something they can do instantaneously. &gt;&gt; yes. the best thing to do is call us and we can help you out with your options. you can short sale it or if you know, depending what position you are in, you might able to just sell it straight up. &gt;&gt; and then obviously there are people who are renting right now, who sat on the sidelines who haven't jumped in and you say that right now is an excellent time to buy a distressed property? &gt;&gt; sure. 100% because you can buy a 100,000 house and your payment will be $650 or $700. you can rent it out or live in it and it's still going to be much cheaper than renting someone else's property. build equity, get tax deductions towards your mortgage payments prmplt we still seeing historically low rates? &gt;&gt; yes, it's incredible rates. one more thing i'd like to add about the short selling. now is the best time because of the capital gains legislative bill will be expiring by the end of this year. so, take advantage of that now. &gt;&gt; and how does that help people? &gt;&gt; well, if you purchase a house for -- or if you have a mortgage of $500,000, and your house is worth $200,000,s if you short sale it or foreclosed on it, you're responsible to pay capital gains on the $300,000 difference. &gt;&gt; at the end of the year. &gt;&gt; that's correct. &gt;&gt; today and this year, it will get forgiven and you will not have to pay any tax on it, those hefty taxes. don't wait until the summer or fall. short sale can take three 0 six months and you don't want to miss that deadline. &gt;&gt; absolutely. &gt;&gt; mike. it's a pleasure. &gt;&gt; great words of advice. thank you so much. &gt;&gt; thank you so much. &gt;&gt; mike specializes in distressed properties.</media:text>

      <media:text>&gt;&gt; welcome back to the blend. did you know you can short sale your home and then remove it from your credit? yeah. it is possible. next guest can help you take advantage of it. if you are faced with housing problems. &gt;&gt; here to tell us more. is attorney jamie with could go burn &amp;amp; associates. welcome back. &gt;&gt; thank you. &gt;&gt;as you know, a lot of people have a home they cannot afford it. and if they can afford it is a bad investment. what would you recommend they do not to ruin their credit. &gt;&gt; one of two things. i would say either stay current and you can short sale your house. or if you are going to go delinquent you could get it removed off your credit. to where it doesn't show that you ever owned the house on your credit. &gt;&gt; so it is possible to do that and no one would know you had bad credit? &gt;&gt; exactly. because actually the trade line gets removed off your credit o it appears as if you never owned the credit. loopholes, basically working the system against them. and they will agree to short sell your house and then end up geting it removed of your credit in 90 days. &gt;&gt;have you perfected time trav? &gt;&gt; i wish. &gt;&gt; that's incredible. can you protect -- one thing that people worry about is are there other assets taken from the bank, or targeted by the bank? &gt;&gt; all in how you structure it to the bank. &amp;amp;-i will be honest. i did 12 years ago, and we facilitated within my office, you know, my short sale comes across with our letterhead. hard to say we have no money at all. but most of our clients, 85 percent of our clients, it is not that they cannot afford it but they do not want it anymore. because neighbor just bought it for 2300 they owe half a million and it is not coming back. &gt;&gt; and typically how long does it affect your credit when you do a short sale? &gt;&gt;well, it will stay on your credit for seven years. but your credit usually bounces back, if you did nothing. anywhere from 12 months to 24 months. -epends on your credit history. &gt;&gt; so if you have other things on your credit. most people short sale, that's the only credit blemish they have. paying their credit cards. student loans. car payments. things like that. so if you have other things on your credit it bounces back quicker. but if you want to be able to buy a home immediately. you need to stay 100 percent current on your loan. or you will need it to remove it off your credit. &gt;&gt; how are you able to delete that off your credit history? &gt;&gt; you actually go back to the lender, and you are disputing it with the lender. and it is aanegotiation process and they remove it. &gt;&gt; in bill collection as well you can negotiate and say here is the settlement. but i can do this? &gt;&gt; correct. and it is a bit more difficult when you are dealing with the lender. but there are loopholes, laws you use in your favor. and ultimately it takes, usually 90 days to get it removed off the credit. so once it reports, then you start the process, and it takes about 90 days. and then, you know, we make sure that it stays off. &gt;&gt; can you then turn around and buy a home that either you can afford or an investment you instant. &gt;&gt; yes. if you are buying a home, now is the time. you are looking at, for the next five years, going to be -- you have so many investors coming in buying homes right now. canadian. asn investors. money is going back overseas. whereas people need to buy homes now. and you are getting a great deal. you are buying stuff for $60 a square foot. &gt;&gt; the way it is here in vegas you could buy the house next door to your house if it is for sale and it will be half the price of your house. same thing?       <media:text>&gt;&gt; welcome back to &quot;the blend&quot; if you are facing problems with your home, don't give up, get help. you don't have to take on all the problems, our next guest is wanting to help you get on track. &gt;&gt; here with what you need to know if you are in this position, frank naply, jr. a lot of people are about to lose their home. what are their options? &gt;&gt; first thing is don't give up. don't let your house go to first option is a loan modification. apply with your bank to present your financial situation to see if they can reduce your monthly mortgage payments. banks, lower interest rates, amortize the loan longer than 30 years and principle reductions. now they are starting to do it more. more government programs coming out to help assist this. &gt;&gt; excellent. youffer loan modifications for free, why? &gt;&gt; yes. obviously, you are having a hard time making payments. loan modifications do take time. if you are in need, we are willing to help you. nothing but time. we'll do it. we are staffed to do it. we have processors that do them all day for people. &gt;&gt; if you don't want to go to loan modification, a lot of people don't qualify. the loan modifications are strict. if you don't, don't let your house go to foreclosure. short sale is when you own more than what it is worth. you can ask the bank to forgive you the difference. &gt;&gt; short sale shows god faith on behalf of the homeowner. your future creditors, they want to see. i see you are having trouble making your payments. you are going to at least bring me a portion and explain why you can't make the payment. i forge you, i understand. a lot of people stop making the payments. then the bank has the right to sue them for the deficiency and pursue them in the future. &gt;&gt; no negotiating. &gt;&gt; you stopped paying, i am coming after you, they have six months to pursue you. they are going to wait until you are making money in the bank and then they are going to go after you. you don't want to get through a foreclosure, repair your credit and be faced with a bank pursuing you. you can't leave anything in your past. sell it now. &gt;&gt; who does the negotiating withh3 c1 the bank? &gt;&gt; we do. from start to finish to the time we go out to the time we get an offer, we negotiate the short sale a-z. we negotiate and present the case and get the clients completely released. when we get the approval letter from the bank. we run it passed our own attorney. &gt;&gt; you have your own attorney, we don't have to hire an attorney? &gt;&gt; no. only time is if you don't do anything about this, let it go to foreclosure, then the bank sues you. in our office, successful short-sale means, the client was able to sell their home, completely forgiven and the bank has waived their right to pursue it in the future. in our office we have done several successful short-sales. not one of our clients has had to pay anything to us. &gt;&gt; the banks pay closing costs which include the costs. that is what we do. &gt;&gt; jr., thank you for the tips thank and his dad frank sr.</media:text>

      <media:text>spencer some state lawmakers are hoping to make it harder for banks and financial institutions to seize your home.megan a bill was introduced recently in the state legislature to help protect homeowners going through the process. kjct news eight's janelle ericsson looked into the bill today and joins us now live with more. janelle? last year alone, the grand junction housing authority saw nearly 250 people face foreclosure. but representative beth mccann says her bill would help people fight for their homes. 3 a new bill will make it harder for banks to foreclose on your home if it's passed. &quot;the bill will require enties that are attempting to foreclose on someone's house so the ones that actually file the foreclosure action to prove to a court that they are the correct entity and that they are entitled to foreclose.&quot; but some local attorney's like jarrod pearson say this proposal just makes more work for them and doesn't change the end result. &quot;it'll be a longer judical proceeding, a longer public trustee proceedi but we're going to end up at the same place.&quot; &quot;lawyers need to be able to prove their case and clients, witnesses have to prove a case you have to bring in documents you can't just say i should win because i should win.&quot; but pearson argues his credibility shouldn't be questioned when he signs a foreclosure. &quot;it's my license that's on the line when i sign that statement saying yes this bank is entitled to proceed with the foreclosure.&quot; pearson also says this new bill is making the foreclosing procedure unbalanced and that could make more problems for people trying to get loans in the future &quot;i guess my prospective is we really have to guard that balance we want to make sure the borrowers are protected but at the same point in time, we have to ensure sufficient protection for the banks for them to be willing to make the loans.&quot; yet the supporter of the bill says this is about making sure homeowners better understand the process. &quot;i'm hoping this will give consumers a much more confident feel about what's going on. and give them the opportunity to really make the foreclosing entity prove their case.&quot; 3 house bill 11-56 has been assigned to committee but there is not a date for it to be heard just yet. representative mccan says in the meantime she's talking to members who will be hearing the bill when that time comes and explaining why she thinks it should become a law. reporting live, janelle ericsson kjct news 8. 3</media:text>

A la mayora de los due&#241;os de propiedad les gusta pagar sus impuestos sobre la propiedad antes del fin de a&#241;o, para poder descontarlos de sus impuestos federales sobre ingresos. pero aquellos que hasta hoy no lo hagan, deben saber que a partir de ma&#241;ana empezaran con 7 por ciento de recargos ...... pueden pagar por el internet, y pueden pagar por telefono, es una nueva opcion, con una tarjeta de credito o convirtiendo su cheque en un cheque electronico..Yodos los bancos Wells Fargo aceptan el pago de impuestos a la propiedad, pero no en dinero en efectivo, tendra que ser en cheque o giro postal.Mientras ms tiempo deje pasar sin pagar sus impuestos sobre la propiedad, le resultar ms caro y ms riesgoso. Las multas pueden subir hasta un 12 por ciento, dependiendo cunto se tarde en pagar.</media:text>

      <media:text>. &gt;&gt; welcome back. are you struggling to keep up on your mortgage payments? many folks in the valley are in this position right now, so how do you know when to keep your home and when to walk away. &gt;&gt; here to tell us what questions you should ask yourself, attorney anthony delucca with delucca &amp;amp; associates. welcome back. &gt;&gt; you've been in the business of helping las vegans for how long. &gt;&gt; for the last decade, i've had my firm, delucca &amp;amp; associates. &gt;&gt; as you know, a lot of people are in very tough times and they don't know if they should give up on their house, walk away or what to do. what advice are you giving them? &gt;&gt; i think the hardest part for people is the emotional they walk away from their home, it's some kind of failure, when it's really not. it's a business decision, not an emotional decision. for many people, their houses are worth literally 30 to 40% of what they owe, and clients with condos that they ppid 180 and worth 40. it's practical decision and if you're struggling, the question is number one, do you really love the home? are you in this because of the emotional battle or is this escape of digging in your heels in saying i'll hold on to this no matter what or is it something else. do you really love the home? do you love the school district and do you love your neighbors? if you don't love your home, what's the fight for in the first place? the second thing is time frame, this is really important. how long do you plan to stay in the home? is this the house where you'll be at for the next 20 years. because they estimate here in las vegas, they say somewhere to 22 to 30 years depending on who you're talking to before your house gets back to where it was. &gt;&gt; &gt;&gt; the third start can you afford it? i mean, a lot of people are saying, i'd have to rent it for same amount or have to go pay rent the same amount of the mortgage, that's really nott true. if the mortgage is 1300 and the rent the s 1300, what about the prerty taxes and the hoa and the maintenance and the insurance. if you're renting a place, you call the landlord and say the water heater is broken, and they come and replace it, but so it's not 1300 versus the 1300 and it comes down to can you afford it. it's not living to live paycheck to paycheck. think about it, if you have a $1500 mortgage and your house is worth 50%, every time you make a payment, do you build equity? &gt;&gt; no. &gt;&gt; you're not going to have equity until your house is back to even. &gt;&gt; paint the picture in the heads of the home owners that the $150,000 home, would you pay $350,000 for it today? &gt;&gt; that's right. a great way to put it. like buying a stock. if you buy a stock at $10, are you going to pay 50 for it? of course not. you don't start an investment $150,000 in the hole. &gt;&gt; this is the most financial decision many of us will make in our lives? &gt;&gt; absolutely, absolutely. that is why people need to look at long interprterm. where can that money be better spent? that is something you can put towards retirement so compound that and see where that comes up to be. &gt;&gt; a lot of cash. &gt;&gt; what do we need to know about bankruptcy if that is an option we're considering? &gt;&gt; if you walk away from the home, the bankruptcy can eliminate the first mortgage and the second mortgage and the big question is what about the taxes? if i don't file bankruptcy and walk away, am i going to get 1099 for the deficient so bankruptcy liquidates that so you won't be responsible for the taxes so at the end of the year, the forgiveness act is going to retire and there is no indication they will reinstate it. &gt;&gt; after 2012 ends, you have pay taxes on what they forgave. &gt;&gt; the deficiency. &gt;&gt; if you're leaning on the fence, the best option is do it. you eliminate your secure debt, your credit cards, medical debts and the loans. &gt;&gt; how is delucca &amp;amp; associates different from any other bankruptcy law firm in town? &gt;&gt; number one, it's the experience. we didn't get into this two or three years ago when the recession tanked. we're a bankruptcy firm and we do all the paperwork for people. we do the credit reporrs so they don't have to make a list of the credit reports and we walk them through it. &gt;&gt; thank you for joining us. &gt;&gt; thank you. &gt;&gt; if you have any questions for anthony, there is hope, so</media:text>

Con disfraces acuaticos activistas protestaban en frente de bancos como JP Morgan, Chase y Bank of America para pedir un alto a la crisis de ejecuciones hipotecarias, y es que segun manifestantes, hay propietarios que estan &quot;bajo el agua&quot; con deudas hipotecarias que superan el valor de sus viviendas. Un promedio de casas perdieron 50 porciento de su valor encontes los due&#241;os se encuentran con una deuda grandisima que no pueden costiar por otros problemas economicos de esta crisis. Don Domingo franco era uno de los muchos indignados que protestaba en contra de esta situacion, segun el una modificacion de prestamo lo ayudaria a salvar su hogar. 
&quot;Me endeude mas con la tarjeta de credito tratando de mantenerme aflote con el prestamo y desde el 2009 he sometido al banco Chase 5 veces la aplicacion completa para la modificacion de prestamo y lo han rechazado porque estoy desempleado.&quot;
De acuerdo a un reporte reciente dla campa&#241;a nacional &quot;The New Bottom Line&quot;, el 25 porciento de las hipotecas en el pais estan bajo el agua, esto tambien quiere decir que muchos propietarios pueden seguir haciendo pagos y no llegar a ser due&#241;os de su propia casa. Ante esto el reporte tambien revela que la unica manera de resolver esta crisis es de reducir el principal de la casa al valor actual lo cual no solo ayudaria al propietario sino que tambien crearia cerca de 35 mil empleos en el estado. El concejal Felix Arroyo se unio a los mas de 150 protestantes pues el ha propuesto una legislatura en donde el presupuesto de la ciudad de boston de mas de un billon de dolares no sea depositado en bancos nacionales que no esten cooperando con la comunidad para terminar con la crisis de ejecuciones hipotecarias. &quot;Yo quiero poner ese dinero a los bancos que esten trabajando bien con la comunidad y no en contra y si pasamos esa propuesta podemos cambiar la economia de la ciudad de boston con esos bancos que acepten que tienen que trabajar con la gente.&quot;
El presidente Barack Obama tambien ha pedido una reduccion al principal de esas casas, sin embargo este aun no se lo ha requerido a los bancos.</media:text>

      <media:text>&gt;&gt; welcome back to &quot;the morning blend.&quot; a new year, a new start for preventing foreclosures to free tax help. our next guest provides the services that will keep you afloat during economic hardships. &gt;&gt; michelle johnson of newly named financial guidance center joins us now with more. welcome back. &gt;&gt; good morning. &gt;&gt; last time we saw you, you were with consumer credit counseling services. you have a name change. tell us what happened. &gt;&gt; we do. we will be known as financial guidance center, new logo, name, and premiere services and premier staff. just a name that will better hopefully serve us as far as the broad range of services that we provide. &gt;&gt; so, there's no change to any offthe services, all of the same awesomeness. &gt;&gt; free help that you have been providing for people. &gt;&gt; absolutely. absolutely. &gt;&gt; let's highlight programs. tax preparations service. this is tax time. &gt;&gt; it has begun. &gt;&gt; people need the help. &gt;&gt; we have people standing in line this morning. unfortunately, our tax site doesn't start until february 1st. we sent them away to come back. we wiil open on wednesday and we vauls for the past eight years have partnered with aarp and the i.r.s. to provide free tax preparation. 9:00 to 3:00 each day monday through saturday and no qualifications. we certainly don't want those that have the six-figure incomes to come take advantage of the free tax preparation. that's note the pprpose. &gt;&gt; that's not the purpose of it. other than that, we don't have any income limitations. and why pay? Patricia Clara ha tenido que mudarse de casa 7 veces en los 8 a&#241;os que lleva viendo en Massachsuetts , y es que segun ella, las altas rentas y malas condiciones de sus anteriores hogares, ha hecho que esto se vuelva un verdadero dolor de cabeza. &quot;Cuando tienes un trabajo que te dan tres o tiempo completo y no te pagan lo suficiente como para ver como logras pagar rentas, no te da porque tienes que pagar por alimentacion y utilidades.&quot; Pero Patricia no es la unica que cree que las rentas en boston son bastante costosas, ya que un reporte por la compania de bienes raices REIS inc. indica que la area metropolitana de boston se ha convertido en la quinta ciudad del pais mas cara en lo que se refiere al pago de rentas de inmuebles. El reporte tambien revela que en el 2011 durante los mes de octubre y diciembre las rentas subieron a 1,686 dolares, comparado con el 2010 donde los alquileres se registraron cerca de 1,649, mientras que el 2009 el estimado era de 1,600. Eliza Parad, organizadora de inquilinos de la colaborativa de Chelsea, atribuye este aumento en parte al alto indice de embargos hipotecarios.
&quot;Hay un mercado mucho mas grande de personas buscando rentar apartamentos porque las personas siguen perdiendo sus casas y los inversionistas y due&#241;os de casas saben que pueden cobrar mas porque saben que hay competencia para rentar apartamentos.&quot;
Otras organizaciones indican que debido a las altas rentas en el mercado tambien hay una larga espera de hasta tres a&#241;os en las viviendas subsidiadas por el gobierno, una alternativa que es bastante buscada por familias de bajos recursos.&quot;Vivimos en los alrededores de las universidades. universitarios que si pueden pagar porque no tienen hijos, pueden vivir 4 o 5 personas en un solo apartamento y no les afecta tanto mientras los que tenemos hijos si nos afecta porque no podemos incluir 5 familias con tres hijos cada familia&quot;
Mientras los expertos predicen que esta tendencia seguira en aumento en los proximos a&#241;os, activistas indican que esto seguira beneficiando a los due&#241;os, y contratadores de viendas mientras no haya un control de rentas regulada por el gobierno.</media:text>
